Acceptance of Terms

Your use of this website, redshiftlabs.com.au and all subdomains (“Site”), denotes your agreement to the Terms of Service (“Terms”) set forth below.

You may not use the Site or our products for any illegal or unauthorised use, including intellectual property laws and all other relevant laws as they operate in your jurisdiction. It is your responsibility to understand, and act in accordance with, all federal, state and provincial laws in the use of the Site and our products.

Conditions of Service

It is a condition of use of our service that you accept and abide our Terms.

Registration

To enable access to the full suite of services offered by the Site, we require you to register an account. You may order from the Site as a guest but, in doing so, you will not have permission to upload content including product reviews, comments, posts or any other contributions.

Conduct

You agree that you are wholly and solely responsible for all content you upload to the Site. Redshift bears no responsibility for the accuracy and nature of user content, to which you may be exposed throughout the Site.

Community Standards

Your continued use of the Site is subject to the conformance of your conduct with our community standards. In your use of the Site, you agree to conduct yourself and any subordinate parties in such a way that does not: harass, threaten, vilify, intimidate, abuse, defame or offend any other party; infringe on the rights of any other party, commit a criminal offence, give rise to civil liability, or in any other way violate laws in your jurisdiction.

By uploading content to the Site, you warrant that you hold the rights to electronically transmit the content and surrender exclusive use of the content to Redshift, to be distributed, reproduced or transmitted in any way we choose.

You represent that the views and opinions expressed in the form of comments, reviews or ratings are your own, that you have no financial or any other interest in their proliferation, that you have not received money or been otherwise compensated for the expression of those views or opinions and no automated tools have been used to upload such content. Any content that is deemed by us to constitute advertising, or suspected by us to be sponsored by an interested party, may be removed without notice.

Termination

We reserve the right to terminate your account and continued use of the Site at any time, should you be in violation of any of these Terms, or the laws of your jurisdiction.

Accuracy and Availability of Information

To the best of our ability, we endeavour to keep product information current and accurate; however there may be occasions where descriptions, quantities or prices are inaccurate or out of date. We reserve the right to refuse or vary the quantities of an order. We take all reasonable steps to ensure the accurate representation of products, including colours, but cannot warrant the exact likeness of colours as they appear on individual monitors and devices. Care is taken to describe features of products as accurately as possible; however if a product is misrepresented such that it cannot be used for its intended purpose, a refund may be issued if desired.

Intellectual Property

All content, designs and attributes of the Site remain the intellectual property of Redshift or our partners and suppliers, protected by copyright, trademarks, designs, patents and other instruments of intellectual property laws.

Payment

Our accepted method of payment is Credit card or Bitcoin. We do not accept PayPal eChecks. We may, at our total discretion, cancel an order, or request additional verification in cases of suspected fraud or misuse of our services. Payments are charged at the time of order. Currency conversion, if applicable, is calculated and applied at Stripe’s rate of exchange at the time of order. All sales are charged in AUD. GST is charged at a rate of 10% of all sales and is due at the time of sale. Listed item prices are inclusive of GST.

Shipping

Orders are normally shipped the next business day. International orders are subject to the terms of service of our courier partners. It is your responsibility to understand and act in accordance with customs, importation, product safety and other relevant laws as they apply in your jurisdiction. You are responsible for any fees, tariffs, taxes, duties, charges, VAT or any other dues importing consumer goods may incur in your jurisdiction. Your emailed receipt may be useful in your local customs authority’s calculation of fees due. Our customs declarations are true and correct and cannot be falsified.

Returns

We accept returns of unmodified, intact items, in their original condition, within 30 days of order placement. Returns may be lodged though the Returns form on the Site. You will be asked to quote your order number and provide a reason for the return. The 30 day return period is calculated from the time of order in your emailed receipt to the time your return form is lodged. All returns are issued as store credit.

Disclaimers

Services, information and products provided by the site are done so without warranties of any kind, except where expressly warranted by product manufacturers or distributers, if at all. Whilst we make every effort to ensure the services, information and product descriptions are current and accurate, we do not warrant that it is so. We fully disclaim all warranties to the extent permissible by law. Redshift does not authorise and cautions against the use of our products in any life-critical devices, devices that have the express purpose of causing harm or injury to a living being, devices that have the propensity to bring about loss of life, harm or injury to a living being, property damage or civil liability if misused, misoperated or in the case of component failure. If you use our products in such fashion, you absolve us of any and all responsibility for damages, costs, civil liabilities and other fees without limitation.

Limitations of Liability

Redshift makes no representation that your use of the Site will not result in damages to, or viruses or malware infecting your computer, telecommunication equipment or other property arising from your access to or use of the Site. In no case shall Redshift, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors, nor any party involved in the creation, production or transmission of the Site, be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, arising from your use of the Site. Our liability shall be limited to the maximum extent permissible by law. You agree that your sole remedy to any issues or errors with the Site is to cease using the Site. You agree that remedy, if any, to problems with products and services offered by the Site, shall be sought from the product manufacturers or service providers, in accordance with the manufacturer’s or supplier’s warranty, or alternatively returns may be sought in accordance with our returns policy.

Revision

You accept that these Terms may be revised at any time without notice.

Jurisdiction

These Terms supersede any other agreement between you and Redshift. Conflicts between these Terms and any other agreement between you and Redshift shall be resolved by the preservation of these Terms. These Terms are governed by and construed in accordance with the laws of the State of Victoria (AU).

Indemnification

You agree to indemnify, defend and hold harmless Redshift and our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including legal fees, made by any third-party arising from your breach of these Terms, the terms of service of any of the aforementioned parties or violation of any law.
